When a loved one passes away, his or her estate often goes through a court-managed process called probate or estate administration where the assets of the deceased are managed and distributed. The average length of time needed to complete the uncontested probate of an estate is six months, depends on the size and complexity of the estate and the local rules and schedule of the probate court.

The uncontested probate process for each estate is unique, but usually involves the following steps, simplified:

$848 OPENING PHASE or $648 Documents Only with Instructions

  • Filing of a Petition with the proper probate court.
  • Notice to heirs under the will or to statutory heirs (if no will exists).
  • Publication in newspaper.
  • Attend Probate hearing.
  • Obtain confirmed copy of Order.
  • Obtain certified copy of Letters.

$1,489 MID-PHASE (Paid After Opening Phase)

  • Establish estate bank account.
  • Provide notice to creditors.
  • Probate notice to government agencies.
  • Appoint probate referee.
  • Notify county assessor.
  • Inventory and appraisal of estate assets by Executor/Administrator.
  • Payment of estate debt to rightful creditors or reject claims.
  • Sale of estate assets, if necessary, with notice.
  • Payment of estate taxes, if applicable.

$1,489 END PHASE (Paid After Mid-Phase)

  • Filing of a Petition for Final Distributions.
  • Waivers of Final Account.
  • Notice of hearing.
  • Check probate notes.
  • Attend hearing.
  • Distribution of assets to heirs and obtain receipts.
  • Record Order of Distribution.
  • File final discharge.

The fees are paid per phase as we move along the process.  Each phase include the standard document preparation for estates (with or without a will) of the California process.  We facilitate all court filings, arrange publication, handle administrative notices, provide ongoing support, and include hands-on case administration throughout the entire probate process.
Description of full service uncontested probate:  Preparation of Petition for Probate, Consent to Full Independent Authority, Declaration re Will or No Will, Nomination of Personal Representative and/or Declination to Act, if required.  Notice of Petition to Administer Estate, Bond Waivers, Declaration re Known Creditors, Probate Cover Sheet, Order for Probate, Letters, Duties and Liabilities of Representative, Confidential Statement, Application to Appoint Probate Referee, Notice to Franchise Tax Board and Healthcare Agency, Notification to County Assessor re Death of Real Property Owner, Inventory and Appraisal, Petition for Final Distribution and Waiver of Accounting, Scheduling and Noticing Hearing on Final Distribution, Preparation of Order for Final Distribution, Receipts, and Ex Parte Application to Relief Representative of Duties.  NOTE:  Any documents required by the client not specifically mentioned are not included in our base flat fee and may require payment of additional fees.  Selection of forms per public service booklet.  Services are contingent on all heirs waiving bond and accounting and all creditors paid in full prior to filing Petition for Final distribution.  Probate cases must be completed within 12 months from completion of the initial interview or an annual fee of $500 will be automatically assessed for each year case remains open.
